The subpoena, issued by plaintiff Justin Holder, commanded the county to produce a corporate designee for testimony related to a court proceeding set for February 5, 2025. However, county officials argue the hearing does not exist, and the scope of the subpoena is vague and unnecessary. Washington County, which was dismissed as a party to the case in 2022, contends that any obligation to participate in the ongoing litigation is baseless, as the case remains statistically closed or stayed.
The motion highlights the delivery of the subpoena by process server Shaun Porter, who was accompanied by an unidentified person in a bunny costume. The encounter was filmed, posted on Facebook, and included comments that officials found offensive. This recording, combined with the frivolity of the bunny suit, led the county to seek relief from the court under Maryland Rule 2-510(e), which protects individuals and entities from annoyance or embarrassment during legal proceedings.

The filing also referenced comments made in the video that were derogatory toward a county attorney, underscoring their argument for the issuance of a protective order.
The motion seeks not only to nullify the subpoena but also to shield the county from further disruptive or frivolous conduct as the legal process continues.
