The charges stemmed from an incident on October 18, 2025, where Baker was accused of assaulting a counter-protester at an Indivisible protest rally. The Hagerstown City Police Department, with Officer D. Altman as the arresting officer, filed the initial charges. Baker was represented by the Public Defender’s Office for Washington County, while the State’s Attorney’s Office for Washington County prosecuted the case.

Baker, who is running as a Democrat for District 2B, is still listed as an active candidate for the upcoming primary election, and will be facing off against Democrat incumbent Matt Schindler.
