A Maryland man has been indicted on federal charges for his alleged involvement in a scheme to defraud healthcare insurers of more than $100 million by submitting fraudulent claims for at-home COVID-19 tests. According to the U.S. Attorney’s Office for the District of Maryland, Marc Aaron Potash, 57, of Rockville, faces charges including conspiracy to commit healthcare fraud and multiple counts of healthcare fraud. The indictment also includes charges for conducting transactions in criminally derived proceeds.

The alleged fraud, which reportedly took place between January 2022 and May 2026, involved Potash, identified as the founder and CEO of Tiero, LLC, a Gaithersburg-based company, and co-conspirators. Their objective, as detailed in the indictment, was to enrich themselves through false and fraudulent claims submitted to Medicare, Medicaid, the Federal Employees Health Benefits Program, and other insurers. The scheme allegedly involved obtaining a Clinical Laboratory Improvement Amendments (CLIA) certification for Tiero by submitting falsified documents to the Maryland Department of Health. These documents purportedly misrepresented the company’s medical providers and falsely claimed on-site COVID-19 testing and analysis.

The indictment further details that Tiero’s CLIA license was then utilized to submit fraudulent claims for COVID-19 tests. These claims reportedly included inaccurate dates of service, fabricated locations where services were supposedly rendered, and the use of a fictitious healthcare provider. In reality, the scheme involved shipping over-the-counter, self-administered COVID-19 test kits to individuals across the nation. The total value of the fraudulent claims submitted is stated to exceed $100 million, with insurers allegedly paying Tiero more than $50 million.

Beyond the healthcare fraud, the indictment also accuses Potash of engaging in several financial transactions involving money derived from these alleged criminal activities. These transactions reportedly include the purchase of luxury vehicles such as a Range Rover and a Mercedes-Benz, as well as the acquisition of real property in Beallsville, Maryland, valued at $4 million. Additionally, two security transfers totaling over $4 million and $8 million, respectively, are cited as part of these alleged criminally derived transactions. If convicted, Potash faces a maximum of 10 years in federal prison for each of the charges he faces. However, actual sentences are typically determined by a federal district court judge after considering U.S. Sentencing Guidelines and other statutory factors. This prosecution is part of a broader federal effort to combat fraud within government benefit programs.
