The Supreme Court of the United States has issued a significant ruling that allows public schools to determine athletic team eligibility for women’s and girls’ sports based on biological sex. This decision addresses whether state laws prohibiting transgender women and girls from participating on these teams violate Title IX of the Education Amendments of 1972. The ruling, as detailed in a statement from Maryland Attorney General Anthony G. Brown, will impact how schools across the nation approach transgender inclusion in athletics.
According to the Supreme Court’s opinion, educational institutions now have the authority to establish eligibility criteria for female sports teams grounded in biological sex. This ruling comes after consideration of cases that directly challenged the scope of Title IX and its application to transgender student-athletes. The implications of this decision are far-reaching, potentially affecting the participation of transgender girls and women in school-sponsored sports programs.

Attorney General Brown expressed his disappointment with the Supreme Court’s decision, stating that it conveys a message of exclusion to transgender women and girls. He argued that broad prohibitions against transgender individuals participating in sports aligned with their gender identity do not foster fairness and instead deny young people essential opportunities for personal development and social connection. The Attorney General emphasized that these policies can prevent children from building confidence, forming friendships, learning discipline, and experiencing the camaraderie of participating in sports alongside their peers.
Maryland has, in contrast to the approach permitted by the Supreme Court ruling, historically opted against implementing blanket bans on transgender youth participation in school athletics. Attorney General Brown affirmed that the state’s position has been one of inclusivity, believing that all children should have the chance to compete and feel a sense of belonging in their school communities. The Maryland Office of the Attorney General has committed to continuing its efforts to ensure that transgender youth are treated with dignity and respect, and are free to express their authentic selves.
This ruling empowers individual states and school districts to enact policies regarding transgender athletes’ participation in sports. Communities and families may see varied approaches to this issue depending on local and state legislation. For transgender youth and their families, this decision may necessitate a re-evaluation of participation opportunities and could lead to increased advocacy efforts to ensure equitable access to school sports. The focus for many will likely shift to how schools implement these new guidelines and the impact they have on the overall school experience for transgender students.
