A Baltimore man has been sentenced to more than ten years in federal prison for possessing a firearm and ammunition as a convicted felon, according to the U.S. Attorney’s Office for the District of Maryland. David Funderburk, 47, received a sentence of 125 months imprisonment, to be followed by three years of supervised release. This conviction marks Funderburk’s fourth federal felony.

The case stems from an incident on November 3, 2023, when detectives from the Baltimore Police Department’s Southwest District were patrolling the 1500 block of W. Baltimore Street. They observed Funderburk exhibiting behavior that suggested he might be armed. Law enforcement then witnessed Funderburk enter a local eatery. While observing him through the establishment’s front window, detectives saw him retrieve a handgun, identified as an FN Five-seven 5.7x28mm, from his pocket, place it on the floor in a corner of the restaurant, and then bend down around a corner. Detectives immediately entered the eatery, detained Funderburk, and recovered the firearm. The handgun was found to be loaded with 18 rounds of 5.7x28mm ammunition.
Funderburk’s prior felony convictions prohibit him from legally possessing firearms and ammunition. This prosecution is part of Project Safe Neighborhoods (PSN), a federal initiative aimed at reducing violent crime and gun violence by fostering community trust, supporting violence prevention organizations, and implementing focused enforcement strategies.
The U.S. Attorney’s Office for the District of Maryland commended the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Baltimore Police Department for their contributions to the investigation.
This sentencing highlights the ongoing efforts by law enforcement to address gun violence in Baltimore. Individuals with prior felony convictions should be aware that possessing firearms and ammunition carries severe federal penalties. The Project Safe Neighborhoods initiative emphasizes collaboration between law enforcement and communities to enhance public safety.
