According to a filing by attorneys representing the Washington County Board of Commissioners, the county revoked its ban on Porter shortly after a lawsuit was filed on April 10. The document, filed in the Circuit Court for Washington County, was part of the government’s effort to strike a supplemental line submitted by a separate plaintiff attempting to cite a July 17 opinion from the Maryland Open Meetings Compliance Board. That opinion had found the county’s six-month prospective ban on Porter violated the Open Meetings Act. In their response, the attorney representing Washington County, Sarah Spitalnick, stated the ban was no longer in effect and had already been rescinded months prior—making the opinion, in their view, moot and irrelevant to the case. “Moreover, the prospective ban referenced in the OMCB Opinion was revoked shortly after the filing of this action on April 10, 2025, and Plaintiffs withdrew their Temporary Restraining Order (TRO) request related to that claim,” stated the court filing provided to Radio Free Hub City, which was dated June 25, 2025 but appears to have been filed on July 25th.

Despite that claim, Porter has continued to appear at county commissioner meetings—and his presence has led to recesses and removals. On multiple occasions since April, county officials have abruptly halted meetings in order to escort Porter out for simply being present in the room. Officials have also discontinued all public comment during County Commissioner meetings.
The July 29, 2025 County Commissioner meeting will be first meeting since the issuance of the OMCB opinion stating that the ban of Shaun Porter was against the Open Meetings Act. It is unknown if the County will attempt to remove Porter under other justification, or allow him to remain in light of the ruling.
Porter has recently filed a lawsuit against multiple county officials and employees claiming first amendment violations.
