The coalition of attorneys general, including Brown, has filed an amicus brief supporting California’s legal effort to halt the deployment. The filing argues that Trump’s order lacks legal justification, since there is no rebellion, invasion, or breakdown of law enforcement capabilities in California. The brief warns that such unchecked presidential authority could set a dangerous precedent, affecting not only California but all states—including Maryland.
The president’s order does not geographically limit the federalization of state National Guard units, raising concerns that similar deployments could happen elsewhere without state consent. The brief emphasizes that the action undermines civilian control of the military, a core principle of American democracy, and potentially endangers the constitutional rights of protesters across the country.

The attorneys general also argue that diverting National Guard members to federal control disrupts essential services. In Maryland and other states, the Guard provides crucial support for disaster response, public safety, and cybersecurity. Their temporary loss leaves gaps that states are unable to quickly fill, further amplifying the impact of the president’s order on daily life and emergency readiness.
Kansas Governor Laura Kelly also signed onto the legal filing, which includes participation from a wide range of states spanning from the East Coast to the West. The case underscores the broader concern among state leaders over the balance of power between state and federal governments, especially in matters involving domestic military deployments.
