Lopez-Gutierrez had been removed from the United States in April 2024 but returned without legal authorization. His presence was uncovered during the course of a broader investigation into the stabbing, although he is not charged in connection with the violent crime itself. Law enforcement located him during their search for associates of the suspect.

He now faces up to two years in federal prison. Sentencing will be determined by a federal district court judge, who will take into account the U.S. Sentencing Guidelines and various statutory considerations. Prosecutors have not disclosed any plea agreement details or sentencing recommendations.
