A Mexican citizen residing unlawfully in Pennsylvania has been indicted by a federal grand jury for illegal reentry, aggravated identity theft, and possession of fraudulent documents, following his prior deportation. The indictment was issued on April 23, 2025, against 50-year-old Herminio Lopez-Gervacio, who was found living in Loganton, Clinton County.

According to federal authorities, Lopez-Gervacio was previously removed from the United States on May 5, 2011, through El Paso, Texas. Despite this prior deportation, he allegedly reentered the country without legal authorization. His presence in Pennsylvania came to the attention of law enforcement on or around February 17, 2025. Investigators say he was also in possession of a fraudulent document and used a stolen identity.
The charges were brought as part of Operation Take Back America, a national enforcement initiative focused on curbing illegal immigration and targeting transnational criminal organizations. This effort combines resources from several federal programs, including the Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhoods, to strengthen community protection and disrupt organized crime.

If convicted, Lopez-Gervacio faces a mandatory minimum sentence of two years for aggravated identity theft, in addition to possible fines and supervised release. The final sentencing would be determined by a federal judge based on statutory guidelines and the circumstances of the case. The case is being prosecuted by Assistant U.S. Attorney Robin Zenzinger and investigated by U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations.
