A federal court has ruled in favor of Restoring Integrity and Trust in Elections (RITE) in a case challenging Maryland’s State Board of Elections (SBE) over public access to voter registration records. The ruling mandates transparency, allowing public access to records needed to verify the accuracy of voter rolls, including information on whether the state is removing non-residents, deceased individuals, and duplicate registrations.

RITE filed the lawsuit in January 2024 on behalf of two citizen activists, alleging that Maryland’s regulation violated the National Voter Registration Act (NVRA). The NVRA requires states to provide public access to records that demonstrate efforts to maintain accurate and current voter registration lists. RITE argued that the SBE’s restrictions hindered necessary public oversight of voter roll maintenance.
The court found that the SBE had breached federal law by limiting access to essential records. The ruling not only halted the enforcement of SBE’s regulation but also marked a significant precedent by stating that voter history information must be made public. The decision is expected to facilitate transparency, allowing the public to assess whether ineligible voters, such as deceased individuals and non-residents, are being properly removed from the rolls.
