An amended complaint has been filed in a high-profile civil rights lawsuit against the City of Surprise, its former mayor, and a police officer. The case, previously reported on after gaining widespread attention last year, stems from allegations of constitutional violations during a city council meeting where the plaintiff was removed and arrested.

The lawsuit, led by Rebekah Massie, details her August 2024 arrest while opposing a proposed salary increase for the city attorney during the council’s public comment period. Massie alleges that Mayor Skip Hall improperly enforced a city policy barring criticism of officials, cutting her remarks short and instructing Officer Steven Shernicoff to remove her. The complaint claims Massie was detained and arrested for trespassing, an act she argues violated her constitutional rights.
“Nearly 150 days ago, I was silenced by Mayor Hall and then assaulted by Officer Shernicoff — both must be held accountable for their actions,” stated Massie. “My hope is that a victory in court will teach the city an important lesson — you cannot attack your constituents for speaking their minds. This is a nation founded on the principles of personal freedom, and something like what happened to me should never be tolerated.”
Following the incident, charges against Massie were dismissed by an Arizona court, which described the city’s actions as “objectively outrageous.” The city council repealed the criticized policy after legal and public backlash. However, Massie’s amended filing seeks to hold officials accountable, citing violations of her First and Fourth Amendment rights, excessive use of force, and the emotional and physical harm caused. Massie is being represented by the Foundation for Individual Rights and Expression (FIRE).
“We look forward to vindicating Rebekah’s constitutional rights, and protecting the rights of all Surprise residents in doing so,” stated FIRE attorney Adam Steinbaugh.
