MARYLAND News (4/11/2024) – In the wake of the recently concluded Maryland General Assembly session, several significant bills have emerged, poised to reshape various aspects of state governance and public welfare pending Governor Wes Moore’s signature. These legislative endeavors span a spectrum of concerns, ranging from healthcare oversight to criminal justice reform.

One notable bill, House Bill (HB) 723, empowers the Office of the Attorney General (OAG) to pursue injunctive relief for infringements upon the rights of residents in healthcare facilities. Aimed at safeguarding the fundamental human rights of vulnerable adults, particularly in long-term care or assisted living settings, this legislation bolsters enforcement measures for violations of the Residents’ Bill of Rights.
Another significant piece of legislation, HB 1002, amplifies the OAG’s authority in investigating healthcare fraud, a pervasive issue draining resources from the healthcare system. By enabling the issuance of subpoenas for medical records vital to fraud investigations, the bill fortifies the state’s arsenal against fraudulent practices.

HB 1047 takes aim at the sensitive issue of sexual assault evidence collection, prohibiting the sale or distribution of self-administered kits while establishing support mechanisms for forensic nurse examiners. This initiative underscores the state’s commitment to ensuring proper handling of sexual assault cases.
Furthering advancements in telehealth services, SB 950/HB 1127 explores the feasibility of conducting sexual assault forensic examinations via telehealth platforms. This dual-purpose legislation not only seeks to expand access to crucial services but also underscores the importance of adapting to evolving healthcare landscapes.

HB 1086/SB 890 represents a continuation of efforts to rectify injustices within the criminal justice system. Building upon the Walter Lomax Act, these bills extend compensation and benefits to exonerees while broadening eligibility criteria, thereby offering a more equitable pathway for those wrongfully convicted.
Additionally, SB 134 establishes the Office of the Correctional Ombudsman, tasked with overseeing administrative actions within correctional facilities and ensuring accountability within the criminal justice system.
Lastly, HB 432 addresses outdated terminology within criminal law statutes, replacing stigmatizing language with more respectful terminology, reflecting a commitment to upholding the dignity of all individuals within the legal framework.
These bills currently await gubernatorial approval and subsequent enactment through the signature of Governor Moore.
