According to court documents, ICE officers encountered Martinez-Montenegro and Ortiz-Berduo in a work truck at the Salisbury worksite. The driver of the truck initially refused to lower the vehicle’s window when approached by law enforcement. As officers prepared to breach the window, the driver agreed to exit the truck. Martinez-Montenegro, who was in the passenger seat, also exited the vehicle. While being detained, Martinez-Montenegro allegedly struck one of the ICE officers. Ortiz-Berduo, a rear passenger, reportedly attempted to flee but was apprehended by officers. Following his apprehension, Ortiz-Berduo is accused of refusing to comply with commands, striking officers, and attempting to use a deployed taser to stab them. ICE officers eventually subdued and arrested both individuals.

If convicted of assault on a federal officer, Martinez-Montenegro and Ortiz-Berduo each face a maximum penalty of one year in federal prison. It is important to note that actual sentences in federal cases are often less than the maximum allowable penalties, as determined by a federal district court judge who considers the U.S. Sentencing Guidelines and other statutory factors.

These cases are part of “Operation Take Back America,” a broad initiative by the Department of Justice aimed at addressing illegal immigration, combating cartels and transnational criminal organizations, and protecting communities from violent crime.
