The agency stated that media reports and statements from certain politicians have contributed to a climate of fear, with some suggesting that parents and children are hesitant to return to school due to potential immigration enforcement actions. DHS is emphasizing that ICE’s mandate does not include making arrests of children at educational institutions. The department’s directive on school enforcement allows agents to carry out their duties while utilizing discretion, requiring secondary supervisor approval for any action taken in sensitive locations like schools, and such instances are expected to be exceptionally rare.
DHS noted that the intention behind these directives is to enable law enforcement to apprehend individuals who pose a threat to public safety. While ICE does not conduct operations at schools, the agency acknowledged that in extremely limited circumstances, such as a dangerous undocumented immigrant felon seeking refuge in a school, or a child sex offender employed by a school, an arrest might be made to ensure public safety. The department asserts that these scenarios are not commonplace and are handled with strict oversight. The Trump administration’s policy aims to allow ICE officers to enforce immigration laws without undue restrictions, focusing on the apprehension of undocumented immigrants who have committed crimes, including violent offenses.
