Maryland and other participating states argue that many of these children eventually resettle in their jurisdictions, becoming part of their school systems and communities. Without legal representation, these minors face immigration proceedings alone, increasing the likelihood of deportation—even in cases where they might legally qualify to stay. The states emphasize that prolonged detention and lack of support can have serious long-term consequences for children’s physical and mental health, making it harder for them to integrate after release.
The coalition contends that federal law acknowledges the critical role legal representation plays for unaccompanied minors and that withdrawing funds creates staffing shortages for legal service providers.
