Trump Orders Investigation Into Alleged Abuse of Presidential Signature Powers

President Trump has directed an investigation into whether aides to President Biden improperly wielded presidential authority during his administration by using an autopen to sign executive actions, despite concerns over Biden’s cognitive abilities. The move signals potential constitutional questions surrounding the legality of policies, judicial appointments, and clemency decisions issued during Biden’s tenure.

The memorandum, issued June 4, outlines concerns that aides may have deliberately concealed President Biden’s cognitive decline to maintain control over executive decision-making. According to the directive, while Biden’s capacity reportedly diminished, thousands of documents, including more than 1,200 executive orders and 235 federal judicial appointments, bore his signature—many allegedly signed using an autopen. Among these were controversial clemency grants in late 2024, where Biden commuted sentences for individuals described as among the most dangerous in federal custody.

Investigators, led by the Counsel to the President and the Attorney General, will examine whether a coordinated effort was made to mislead the public about Biden’s health and whether advisors conspired to assert executive authority without proper constitutional standing. The probe will review the authenticity and direction behind executive actions and public communications during the latter half of Biden’s presidency.

Specifically, the investigation will focus on identifying documents signed mechanically and determining who authorized the use of the autopen. It will also scrutinize any internal agreements among Biden’s aides to suppress or distort information regarding his health, including manipulating public perception through false statements or edited recordings. The findings could impact the legitimacy of numerous policy initiatives and appointments made during Biden’s time in office.

The memorandum clarifies that the investigation does not confer any enforceable rights and is intended solely to ascertain the facts surrounding the alleged misconduct. President Trump emphasized the importance of restoring integrity to the Office of the President and ensuring accountability for any unconstitutional actions taken during the previous administration.
