Garcia-Diaz was encountered by federal authorities on February 6, 2025, in Tioga County. Officials allege he had not obtained permission to lawfully reenter the United States. He now faces charges of illegal reentry, a federal offense that could result in up to ten years in prison, supervised release, and a fine, pending judicial review and sentencing under federal guidelines.
The investigation was conducted by U.S. Immigration and Customs Enforcement and Removal Operations, with prosecution led by Assistant U.S. Attorney Geoffrey W. MacArthur. The case is part of Operation Take Back America, a Department of Justice initiative focused on targeting illegal immigration and dismantling transnational criminal organizations.

This operation also draws on resources from Project Safe Neighborhoods, a program designed to reduce violent crime through coordinated law enforcement efforts. Federal authorities emphasized that indictments are not convictions and Garcia-Diaz remains presumed innocent unless proven guilty in court.
