Avila attempted to enter the United States on January 11, 2025, when CBP officers flagged him as a potential match for an outstanding arrest warrant. Upon further inspection, biometric verification confirmed his identity and the validity of the warrant, which dates back to June 2009. The charges accuse Avila of sexually assaulting a child under the age of 14, a first-degree felony in Texas.
CBP officers transferred custody of Avila to a Hidalgo police officer, who transported him to the Hidalgo County jail. He will remain there pending extradition to Harris County, where the case will proceed. As in all cases, Avila is presumed innocent until proven guilty in a court of law.
