President Joe Biden has signed the Social Security Fairness Act into law, effectively repealing the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO). This legislative change is set to increase Social Security benefits for nearly 3 million current and former public employees, including teachers, firefighters, and police officers.

The WEP and GPO were provisions that reduced or eliminated Social Security benefits for individuals who also received pensions from employment not covered by Social Security taxes. By abolishing these provisions, the new law ensures that public sector retirees receive full Social Security benefits in addition to their public pensions.

While the legislation addresses long-standing concerns about benefit reductions for public servants, it introduces additional financial strain on the Social Security Trust Funds, which are already facing potential insolvency by 2035. The Congressional Budget Office estimates that this change will accelerate the depletion of the retirement trust fund by approximately six months.
