The incident that led to Cummings’ arrest occurred on September 20, 2023, when he appeared at the Northern York Regional Police Department. He was reportedly wearing what appeared to be a U.S. Marshal badge, along with tactical gear and clothing, and was carrying a firearm. During his interaction with the police, Cummings represented himself as a Deputy U.S. Marshal. However, local law enforcement officers recognized that he was not an authorized officer. Following his departure from the police station, Cummings was later stopped by law enforcement. A subsequent search of his vehicle and residence revealed a collection of firearms, ammunition, and several rifles that measured less than sixteen inches in length. The possession of these short-barreled rifles was deemed illegal. In determining the sentence, Judge Neary took into account Cummings’ prior criminal history, his personal circumstances, and the gravity of his actions. The investigation into this case was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Northern York Regional Police Department. Assistant United States Attorney Michael A. Consiglio is prosecuting the case. This prosecution is part of a broader initiative known as Operation Take Back America, a national effort by the Department of Justice aimed at combating illegal immigration, dismantling cartels and transnational criminal organizations, and addressing violent crime. The operation consolidates resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN) programs.
