A Mexican national residing in the United States has been sentenced to 24 months in prison followed by one year of supervised release for possessing a firearm as an alien. The sentence was handed down by United States District Judge Jennifer P. Wilson.

The case began in 2021 when Pennsylvania State Police initiated a traffic stop of Diego Edgardo Aleman-Lozano, age 25, for motor vehicle code violations. During the stop, officers observed a 5.56 caliber rifle cartridge on the front passenger seat of the vehicle. Due to Aleman-Lozano’s status as an alien on a nonimmigrant visa, his possession of a firearm or ammunition was prohibited. A subsequent search warrant executed on the vehicle by law enforcement uncovered a 9mm polymer semi-automatic pistol that lacked a serial number.
This prosecution is part of a broader federal initiative known as Operation Take Back America. This nationwide effort aims to address illegal immigration, combat cartel and transnational criminal organizations, and protect communities from violent crime. The operation coordinates resources from the Department of Justice’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN) programs. The investigation into this firearm offense was conducted by the United States Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), with the case being prosecuted by Assistant United States Attorney Michael Scalera. The delay in issuing the press release was attributed to a government shutdown.
