The U.S. Food and Drug Administration (FDA) is initiating a nationwide effort to encourage retailers to voluntarily stop selling unauthorized vaping products, many of which are illegally imported and targeted at young people with appealing flavors and marketing. The agency is providing educational materials to over 300,000 retailers across the country as part of its strategy to combat the rise in youth vaping.

The FDA’s Commissioner of Food and Drugs, Martin A. Makary, M.D., M.P.H., announced the initiative, emphasizing the critical role retailers play in the distribution of both legal and illegal tobacco products. These illegal vapes, often featuring candy and fruit flavors, and even incorporating features like built-in video games or Bluetooth speakers, have not received authorization from the FDA. A significant portion of vaping products available nationally, estimated at up to 54%, are believed to be illegal. Concerns have been raised about the composition of these unauthorized products, with reports indicating they may contain harmful chemicals such as formaldehyde, lead, and acrolein, substances typically found in industrial materials and pesticides.

To assist retailers in understanding what products are permissible to sell, the FDA is distributing comprehensive informational packets. These mailings, set to commence this fall, will include a definitive list of the 39 e-cigarette products and 20 nicotine pouch products that have been authorized for marketing in the United States. For ease of access, these lists will feature QR codes directing users to real-time digital versions maintained on the FDA’s website. Additionally, retailers will receive guidance on how to access the FDA’s new Searchable Tobacco Product Database. This extensive database contains information on over 17,000 tobacco products across various categories, including cigarettes, cigars, hookah, and e-cigarettes, that are legally permitted for sale. The educational materials also include a wall calendar designed to serve as a constant reminder of retailer obligations, such as ensuring all tobacco product sales are to individuals aged 21 and older and requiring photo identification checks for anyone appearing under the age of 30.

The FDA acknowledges that the majority of businesses aim to operate within legal frameworks. The primary objective of this outreach is to enhance retailer comprehension of pertinent laws and regulations, thereby eliminating any potential justifications for non-compliance. The agency is particularly focused on improving adherence to rules regarding the distribution and sale of illicit vaping products, which are frequently marketed to and widely used by adolescents. Retailers seeking to obtain additional complimentary materials, including a digital version of the age verification calendar, can access them through the FDA’s Tobacco Education Resource Library.
