Immigrants living illegally in the United States now face a significantly quicker process for receiving civil fines under a new federal rule announced jointly by the Department of Homeland Security (DHS) and the Department of Justice (DOJ). The regulation removes several procedural steps, allowing immigration authorities to issue penalties faster and more efficiently.

Previously, DHS was required to issue a 30-day notice before fining individuals unlawfully present in the country. That notice period has been eliminated, and immigration officers may now deliver fine notices by regular mail. The rule also accelerates the process for contesting fines, reducing administrative delays. According to DHS, these changes aim to increase enforcement efficiency and deter unlawful presence.
Financial penalties under the new rule apply to multiple categories of immigration violations. These include unlawful entry, refusal to comply with removal orders, or failure to depart voluntarily after agreeing to do so. The fines range from $100 to $500 per unauthorized entry, nearly $10,000 for not following voluntary departure agreements, and up to $998 per day for failing to leave after a removal order.

The practice of issuing fines for these offenses was first implemented during Donald Trump’s earlier term but was suspended under the Biden administration. With Trump’s return to the presidency in 2025, Immigration and Customs Enforcement (ICE) resumed issuing such fines on June 13. Since then, nearly 10,000 notices have been mailed. To encourage voluntary compliance, the government is offering fine forgiveness for those who self-deport using the CBP Home app, a mobile platform designed to streamline voluntary departure.
Residents nationwide can expect immigration enforcement to become more visible and financially impactful under the new policy. Those unlawfully present may face sudden fines without prior notice, and legal residents could observe heightened enforcement efforts in their communities. DHS has emphasized that the best option for illegal immigrants is to begin the self-deportation process immediately through the government’s app to avoid penalties.
