The Department of Homeland Security has issued a formal reminder to members of Congress regarding procedures for visiting Immigration and Customs Enforcement (ICE) detention centers, following a recent incident at Delaney Hall. The reminder comes after three Congressional representatives forcibly entered the facility and allegedly assaulted ICE agents during the unapproved visit. DHS emphasized that such actions were unnecessary, as access would have been granted through standard scheduling channels.

According to DHS, the lawmakers could have simply requested a tour in advance, as ICE routinely accommodates Congressional oversight visits. Assistant Secretary Tricia McLaughlin stated that Secretary Noem supports the oversight role of Congress but reiterated that elected officials are not exempt from federal laws and facility rules. Despite the initial confrontation, ICE ultimately permitted the lawmakers to complete a tour of the detention center.
ICE guidance outlines the steps required for Congressional access to detention facilities. Lawmakers or their staff must submit a request in advance, particularly if they wish to meet with specific detainees. These requests must include the detainees’ names, alien registration numbers, and signed privacy waivers. When no specific detainees are named, at least 48 hours’ notice is required to allow ICE to notify potential participants and process any necessary documentation.

ICE stressed that safety and security are the top priorities at its facilities. All visitors, including Congressional members and their staff, must be properly identified, undergo searches, and comply with attire guidelines. Any introduction of contraband or other criminal acts may result in prosecution. DHS reiterated that these protocols are in place to protect detainees, staff, and visitors alike.
ICE encourages all members of Congress to familiarize themselves with the official guidance and follow the proper channels to arrange visits to detention sites.
