The U.S. Department of Homeland Security (DHS) is formally requesting the Department of Justice pursue capital charges against two Mexican nationals following a maritime human smuggling incident that led to multiple fatalities. Secretary of Homeland Security Kristi Noem announced the request after a panga-style boat carrying 16 people capsized near Torrey Pines, San Diego, resulting in at least three deaths and several others missing. The Department is citing provisions under the Immigration and Nationality Act and the Federal Death Penalty Act to support its call for the death penalty.

The incident occurred on May 5, 2025, when the United States Coast Guard (USCG) Sector San Diego responded to a distress report from the North County Dispatch Joint Powers Authority. The overturned vessel, commonly used in smuggling operations, had come ashore, prompting a multi-agency response involving U.S. Customs and Border Protection, Border Patrol, and San Diego Fire-Rescue. Survivors interviewed by Border Patrol agents confirmed that the vessel initially held 14 adults and two minors. Three Indian nationals were confirmed dead, while seven others remain unaccounted for.
Two of the survivors, both Mexican nationals, were taken into custody on suspicion of human smuggling. The DHS has indicated that these individuals played a role in orchestrating the illegal transport. The deaths triggered a deeper legal review, which concluded that the circumstances met the statutory criteria for capital punishment under federal law. Authorities are continuing the search for the missing individuals.

In her announcement, Secretary Noem emphasized the grave risks and deliberate criminality associated with maritime smuggling, describing the incident as both avoidable and driven by profit motives. She underscored the department’s position that such acts, when resulting in loss of life, warrant the highest legal consequences available. The DHS plans to collaborate closely with the Department of Justice to ensure full prosecution of the suspects and to deter future smuggling attempts through strong legal action.
