A child has been removed from her parents’ custody by the U.S. Department of Homeland Security due to confirmed ties between both parents and the violent Venezuelan criminal organization known as Tren De Aragua. According to federal authorities, Maiker Espinoza-Escalona, the child’s father, is a senior lieutenant within Tren De Aragua and is allegedly responsible for overseeing homicides, drug distribution, kidnappings, extortion, and sexual trafficking, as well as managing a facility used for torture. The child’s mother, Yorely Escarleth Bernal Inciarte, is reported to be involved in recruiting women for illicit activities. Both individuals entered the United States illegally and had been ordered removed by an immigration judge prior to their detention.
The Department of Homeland Security coordinated with the Department of Health and Human Services to exclude the child from her parents’ deportation proceedings. Officials stated that this decision was made to ensure the child’s safety, and she has since been placed with a foster family under the care of the Office of Refugee Resettlement. DHS emphasized that the child’s exposure to criminal environments constituted an immediate threat to her welfare.

Federal officials pointed to recent policy changes under the current administration as instrumental in facilitating child protection efforts at the border. In less than 100 days, DHS and HHS report having reunited over 5,000 unaccompanied minors with verified family members or guardians deemed safe. Officials also drew contrasts to prior immigration practices, which they claim allowed children to be placed with individuals later found to be involved in trafficking or exploitation.
The Venezuelan government has criticized the U.S. for what it described as a “kidnapping,” but DHS maintains that the child’s removal from her parents was justified based on their direct involvement in organized transnational crime. U.S. officials reiterated that protecting vulnerable minors remains a central objective of immigration enforcement and child welfare policy.
