The 2024 legislation, signed into law on December 22, 2023 by President Biden, prohibited the creation of new DEI positions and restricted the filling of existing vacancies, in addition to capping pay rates for civilian staff engaged in DEI-related work. These statutory limitations triggered an initial round of workforce restructuring within the Department of Defense. According to data reviewed by the Government Accountability Office (GAO), the department responded by eliminating or modifying existing DEI roles, which previously supported initiatives like training development, data analysis, and coordination of internal DEI committees.

By January 2025, a new series of executive orders by President Trump directed all federal agencies to terminate DEI programs entirely. The Department of Defense acted accordingly, abolishing the remaining 41 civilian and military DEI positions and disbanding its DEI advisory committee. A task force was also launched to oversee the complete closure of DEI offices throughout the department.

Instead, internal personnel managed these functions, which included responding to congressional reporting requirements and supporting departmental DEI goals.
