The charges underscore the Department of Justice’s commitment to upholding the integrity of the electoral process. Officials have emphasized that voting is a fundamental right reserved exclusively for eligible U.S. citizens. Election fraud is considered a serious offense, and the Department intends to prosecute such cases vigorously. The indictment against Guzman specifies the charge of voting as an alien, while Holtzman faces charges for his alleged role in facilitating the illegal vote through false statements and fraudulent registration.
The investigation into these allegations was conducted by Homeland Security Investigations (HSI), with Assistant United States Attorney Scott Ford assigned to prosecute the case. These indictments are part of a broader national initiative known as Operation Take Back America, which aims to combat illegal immigration and related criminal activities. If convicted, Holtzman could face a maximum of 10 years in prison, supervised release, and a fine. Guzman, if convicted, faces a maximum of one year in prison, supervised release, and a fine. It is important to note that indictments are formal accusations, and all individuals charged are presumed innocent until proven guilty in a court of law.
