ID Logistics US, Inc. to Pay Over $2.3 Million to Settle PPP Loan Misuse Claims

HARRISBURG, PA – ID Logistics US, Inc. (IDUSA) has agreed to pay $2,362,360 to resolve allegations that it improperly received a Paycheck Protection Program (PPP) loan, according to the U.S. Attorney’s Office for the Middle District of Pennsylvania. The PPP was established as part of the Coronavirus Aid, Relief, and Economic Security (CARES) Act in March 2020, offering forgivable loans to small businesses to help retain employees and cover other expenses during the economic impact of the COVID-19 pandemic. For a business to qualify for a PPP loan, it had to certify its eligibility, including meeting employee count thresholds when considering its affiliated entities.

IDUSA, a subsidiary of the French company ID Logistics Group SA, operates with numerous affiliated companies globally. The U.S. Attorney’s Office alleged that IDUSA applied for a PPP loan by falsely certifying that it, along with its affiliates, had fewer than 500 employees. The investigation indicated that when affiliated entities were included in the count, IDUSA exceeded the 500-employee limit, making it ineligible for the loan. The settlement resolves a lawsuit initially filed by a private party under the False Claims Act, which allows individuals to sue on behalf of the United States and receive a portion of any recovered funds. In this case, the whistleblower is set to receive $236,236 of the settlement amount.

The resolution of this matter signifies a commitment to ensuring that pandemic relief funds were distributed as intended. The Paycheck Protection Program aimed to provide a critical safety net for businesses genuinely struggling and eligible under the program’s criteria. By pursuing and resolving these allegations, the government seeks to recover funds that may have been improperly obtained and hold accountable those found to have misrepresented their eligibility.

IDUSA fully cooperated with the United States investigation and agreed to the settlement terms once made aware of the inquiry. The Small Business Administration has stated its dedication to identifying and recovering all instances of Paycheck Protection Program fraud. The investigation and resolution were managed by Assistant U.S. Attorney Tamara Haken and the Affirmative Civil Enforcement Unit within the U.S. Attorney’s Office for the Middle District of Pennsylvania. It is important to note that the claims resolved by this settlement are allegations only, and no determination of liability has been made.
