By reclassifying broadband service as a Title II telecommunications service, the FCC was empowered to safeguard consumer interests, uphold national security imperatives, and promote public safety. Importantly, the Commission’s decision delineated a regulatory framework that aimed to strike a balance between oversight and fostering innovation and investment in the broadband sector.

Central to the FCC’s action was the restoration of net neutrality principles, which prohibited internet service providers from blocking, throttling, or engaging in paid prioritization of lawful content. These rules, initially upheld by the D.C. Circuit in 2016, were reinstated, signaling a commitment to preserving an open and level playing field for online content and services.

Furthermore, the FCC’s decision granted the Commission authority to address national security concerns by revoking authorizations for foreign-owned entities that posed threats to national security in operating broadband networks within the United States. This measure underscored the importance of protecting critical infrastructure from potential vulnerabilities and ensuring the integrity of telecommunications networks.

Another key aspect of the FCC’s renewed mandate was its enhanced ability to monitor and respond to internet service outages. Recognizing the indispensable role of broadband connectivity in various facets of modern life, the Commission stood poised to intervene when disruptions occurred, thereby mitigating the impact on individuals, businesses, and educational institutions reliant on internet access.

The FCC’s action represented the culmination of a lengthy regulatory process dating back to 2004, when the agency’s then-chairman called upon the broadband industry to uphold “Internet Freedoms.” Over the ensuing decade, the FCC diligently pursued measures to safeguard these freedoms, culminating in the restoration of net neutrality principles and the reassertion of its authority over broadband services.
